These Terms govern your use of the services provided by Greenpoint Controls ("Service") and set forth the legally binding agreement between you ("Customer") and Greenpoint Controls. By using our Service, you agree to be bound by these Terms.
1.1 The Service operates exclusively within the United States of America.
1.2 The Service provides IoT devices that are designed to be installed on Customer's equipment for data collection purposes.
1.3 To use the Service, Customer must agree to transmit the equipment data collected by the IoT device through the Internet to the Service's cloud platform.
1.4 Customer acknowledges and agrees that the data collected by the IoT device will be stored on the servers operated by the Service.
1.5 The Service may, at its discretion, initiate remote updates or troubleshooting by sending update files or commands to the IoT devices installed on Customer's equipment.
2.1 The Service is committed to protecting the privacy and security of Customer's data. Customer's data will be handled in accordance with applicable laws and regulations.
2.2 Customer acknowledges that transmitting data through the Internet entails inherent security risks and that the Service cannot guarantee the absolute security of the data during transmission.
2.3 Customer is solely responsible for maintaining the confidentiality and security of their login credentials, including their password. The Service encourages Customer to use strong, unique passwords and to take necessary precautions to protect their login information.
3.1 Low Voltage IoT Device Safety:
a. Customer acknowledges that the IoT devices provided by the Service operate on low voltage and must be handled with caution.
b. Customer agrees to strictly follow all safety guidelines and instructions provided by the Service and any applicable laws and regulations while handling the IoT devices.
3.2 Mechanical Safety:
a. Customer acknowledges that installing the IoT devices on their equipment may involve mechanical processes and potential risks.
b. Customer agrees to take necessary safety precautions, such as wearing appropriate personal protective equipment and following industry best practices, while installing the IoT devices on their equipment.
4.1 The Service shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or relating to the use or inability to use the Service, including but not limited to damages for loss of profits, data, or other intangible losses.
4.2 Customer agrees that any claims arising from or relating to the use of the Service must be brought within one year from the date on which the claim arose.
5.1 The Service reserves the right to suspend or terminate Customer's access to the Service at any time without prior notice, in the event of a violation of these Terms or any applicable laws or regulations.
5.2 Customer may terminate their use of the Service at any time by following the termination process specified by the Service.
6.1 These Terms shall be governed by and construed in accordance with the laws of the United States of America.
6.2 Any disputes arising out of or in connection with these Terms shall be resolved through amicable negotiations. If the dispute cannot be resolved amicably, the parties agree to submit to the exclusive jurisdiction of the courts located within the United States of America.
By using the Service, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, please refrain from using the Service.
